Terms of Use

These Terms & Conditions of Service for Handylist Services ("Agreement") form a legal agreement between you and Handylist LLC. By using or accepting the Services, you agree to be bound by the terms of this Agreement. If you do not agree to the Terms of this Agreement, do not use Handylist Services.

You agree that your use of the services acknowledges that you have read this Agreement, understand it, and agree to be bound by its Terms and Conditions.

Terms

You must be 13 years and older to use this site.
You must not abuse, harass, threaten, impersonate or intimidate other Handylist users.
You may not use the Handylist.org service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
You must not modify, adapt or hack Handylist.org or modify another website so as to falsely imply that it is associated with Handylist.org.
You must not create or submit unwanted email to any Handylist members ("Spam").
You must not transmit any worms or viruses or any code of a destructive nature.
You must not, with the use of Handylist, violate any laws in your jurisdiction, either State, National or International laws (including but not limited to copyright laws).
You are responsible for any activity that occurs under your screen name or email address.
You are responsible for keeping your password secure.

Conduct

You agree not to post or email Content which:

is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
harasses or advocates harassment of another person;
involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing, "spamming", contests, sweepstakes or pyramid schemes.
involves sending unsolicited emails of any kind to emails listed on Handylist or through the Handylist email system
promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
seeks to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
displays pornographic or sexually explicit material;
provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

In addition, you may not:

use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service unless permitted my Handylist
post non-local or otherwise irrelevant Content;
repeatedly post the same or similar Content in more than one classified category or forum, or in more than one metropolitan area

While Handylist.org prohibits such conduct and content on its site, you understand and agree that Handylist cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Handylist.org service at your own risk.

RSS

Handylist provides RSS feeds and permits you to display, excerpt from, and link to the RSS feeds on your personal website or personal web blog, provided that (a) your use of the RSS feed is for personal, non-commercial purposes only, (b) each title is correctly linked back to the original post on Handylist.org, (c) you provide, adjacent to the RSS feed, proper attribution to "Handylist" as the source, (d) your use or display does not suggest that Handylist promotes or endorses any third party causes, ideas, web sites, products or services, (e) you do not redistribute the RSS feed, and (f) your use does not overburden Handylist's systems. Handylist reserves all rights in the content of the RSS feeds and may terminate any RSS feed at any time.

General Conditions

You are solely responsible for any "Content" you post, transmit, or link to using Handylist.org. "Content" includes postings, flyers, data, text, information, screen names, graphics, photos, profiles, audio and video clips, and links.
Handylist does not control any of the "content" on the site. You agree that the use of Handylist.org and the Handylist service is entirely at your own risk. The Handylist service is provided on an "as is" basis without any warrantees of any kind.
Under no circumstances shall Handylist be liable for direct, indirect, incidental, special, consequential or exemplary damages resulting from any aspect of your use of the Handylist site or services.
Handylist reserves the right to modify or terminate the Handylist.org service for any reason, without notice at any time.
Handylist reserves the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you only by posting the change here, on this Terms of Use page. What qualifies as "material change" will be determined at our sole discretion.
Handylist reserves the right to refuse service to anyone for any reason at any time.

Handylist has no responsibility or liability for the deletion or failure to store any Content maintained or transmitted by the Service.
We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
The Handylist service makes it possible to post postings and flyers hosted on Handylist to outside websites. This use is encouraged. However, pages on other websites which display images hosted on Handylist.org must provide a link back to Handylist from each posting or flyer to its posting or flyer page on Handylist.

Copyright

If you believe that someone has infringed on your copyright using the Handylist service, please contact us. Copyright Agent, Handylist, 703 Market St. Suite 470, San Francisco, CA 94103. Handylist may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers. Please provide Handylist the following information, and we will remove the infringing posting(s), subject to the the procedures outlined in the Digital Millenium Copyright Act (DMCA). A) A description of the copyrighted work or other intellectual property that you claim has been infringed. B) A description of where the material that you claim is infringing is located on the site. C) Your address, telephone number, and email address. D) Your physical or electronic signature. E) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. F) A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner.

Handylist does not claim ownership of content posted by its users. However, by posting Content to any public area of Handylist, you automatically grant, and you represent and warrant that you have the right to grant, to Handylist an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute said Content and to prepare derivative works of, or incorporate into other works, said Content, and to grant and authorize sublicenses of the foregoing.

Indemnity

You agree to indemnify and hold Handylist, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms & Conditions and/or any breach of your representations and warranties set forth above.

All questions relating to this website's validity, interpretations, performance and enforcement, including the Terms & Conditions, shall be governed by and construed in accordance with the laws of the State of California. Any action relating to this website's validity, interpretations, performance and enforcement, including the Terms & Conditions, must be brought in the federal or state courts located in San Francisco, CA, and you irrevocably consent to the jurisdiction of such courts. Our failure to enforce your strict performance of any provision of these Terms & Conditions will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this policy. Any waiver, amendment or other modification of any provision of these Terms & Conditions will be effective only if in writing and signed by an authorized representative of Handylist.

Entire Agreement

These Terms & Conditions represent the complete and entire agreement between Handylist and you and supersede all prior and contemporaneous agreements of the parties relating to the subject matter hereof.
